1. Purpose and scope
1.1 This Wholesale Fair Usage Policy (the Policy) applies to all mobile services Plan Communications Limited (Plan) provides to its Wholesale Partners (each a Partner) for onward supply to their End Users.
1.2 The Policy ensures allowances marketed as “Unlimited” are used in line with normal commercial practice, protects network integrity, and sets out when and how overage charges apply if usage exceeds the thresholds below.
1.3 This Policy forms part of the Wholesale Agreement and (where referenced) the Order Form, Tariff Guide, and any service-specific schedules. If there is any conflict, the Wholesale Agreement prevails.
2. Definitions
2.1 Aggregated Tariff means a tariff where data allowances are pooled across a defined group of SIMs for a single Customer account.
2.2 End User means a Partner’s customer or user of a SIM provisioned under the Wholesale Agreement.
2.3 Overage means chargeable usage that exceeds a fair usage threshold or inclusive allowance.
2.4 Permanent Roaming means roaming use that exceeds fair periodic travel as described in clause 6.
2.5 Roam Like at Home (RLAH) means the roaming proposition permitting use of domestic allowances in designated countries, subject to fair-usage limits.
2.6 Tariff Guide means Plan’s then-current wholesale tariff and pricing guide applicable to the services.
2.7 Order Form means the ordering document agreed between Plan and the Partner describing the services, term and commercial terms.
2.8 Unlimited means no pre-set inclusive allowance, but subject to the fair usage thresholds and restrictions in this Policy.
3. General acceptable use
3.1 Services are for legitimate business and personal communications using standard mobile handsets or approved devices.
3.2 Partners must not permit, and must prevent, any use that is fraudulent, abusive, unlawful, harmful, or that materially degrades network performance.
3.3 Prohibited uses include:
- a) GSM gateways/SIM boxes or any device/application that routes or originates large volumes of calls, SMS or data.
- b) Artificially Inflated Traffic (AIT), nuisance calls, spam, or persistent unsolicited communications.
- c) Use that causes network congestion or adversely impacts other users.
- d) Excessive tethering (for example, connecting 12 or more devices to one SIM or using it as fixed access).
- e) First activation outside the UK or patterns inconsistent with periodic travel.
3.4 Plan may request reasonable cooperation and information from Partners to investigate suspected misuse or breach.
4. Unlimited allowances – UK usage (on-net/domestic)
4.1 Fair usage is 500 GB per SIM per billing cycle unless otherwise stated.
4.2 Fair usage is 3,000 UK minutes and 3,000 UK SMS per SIM per billing cycle unless otherwise stated.
4.3 Where a SIM exceeds these thresholds, Plan will apply overage at published wholesale rates.
4.4 If usage repeatedly or materially exceeds fair usage over two or more billing cycles, Plan may restrict, throttle, migrate, suspend or terminate the SIM.
5. Aggregated tariffs
5.1 For aggregated data tariffs, thresholds and overage rules apply to the aggregate pool unless otherwise specified.
5.2 If the pool is exhausted, overage is billed at published rates.
5.3 Partners must ensure pool composition complies with tariff rules.
6. Roaming (Roam Like at Home and other roaming propositions)
6.1 Inclusive roaming is designed for periodic travel.
6.2 When roaming in RLAH locations, 25 GB per SIM per billing cycle applies to Unlimited data tariffs unless otherwise stated.
6.3 Permanent roaming test: if over any rolling 4-month period a SIM is used outside the UK more than 50% of the time and roaming usage exceeds domestic usage, Plan may apply surcharges, restrict, or disconnect after notice.
6.4 Non-tiered destinations are charged per the Tariff Guide.
7. Prohibited devices and traffic types
7.1–7.8 Use of GSM gateways, SIM boxes, AIT, tethering abuse, spoofing, or unauthorised routing is prohibited. Plan may block or suspend offending SIMs, charge overage, migrate tariffs, or terminate for breach.
8. Traffic management and quality protection
8.1–8.7 Plan may apply proportionate traffic management to protect service quality.
Measures are temporary, targeted, and limited to affected services.
Emergency calls are not affected. Usage records remain the billing authority.
9. Monitoring, notifications and remediation
9.1–9.7 Plan monitors usage and issues alerts where practical.
Partners must cooperate, act on misuse notifications, and may request billing reviews.
10. Charges, billing and top-ups
10.1–10.8 Overage is billed per MB/GB, minute or SMS.
Rates follow the Tariff Guide.
Top-ups apply prospectively.
Plan may apply deposits or spend controls if usage exceeds limits.
11. Enforcement
11.1–11.2 If thresholds are exceeded or the Policy is breached, Plan may apply charges, restrict or terminate services, and take immediate action where required to protect the network.
12. Partner responsibilities
12.1–12.3 Partners must ensure their End Users follow equivalent fair usage terms, are informed about thresholds, and are responsible for all charges.
13. Representations of “Unlimited”
13.1–13.2 Partners must not market Unlimited allowances as “uncapped” or “truly unlimited”.
Thresholds and limits must be clearly stated in all materials.
14. Changes to this Policy
14.1–14.2 Plan may update this Policy and will notify Partners of material changes in accordance with the Wholesale Agreement.
